Notary near me. Sound familiar? Have you ever completed an important document like a Power of Attorney or a court ordered document, only to find out that it requires the seal of a Notary Public? Chances are, you surely have/will in your adult life. But what exactly is a Notary Public?

The main role of a notary public is to screen signers of important documents, which means making sure they are who they say they are.

When people sign property deeds, wills, powers of attorney, and many other documents, it is the job of the notary to identify each person and to ensure their willingness to sign without duress or intimidation. A Notary Public is an official of integrity appointed by state government — typically by the secretary of state, and is authorized by law to perform six basic duties:

  1. Administer oaths or affirmations
  2. Take acknowledgements
  3. Attest to photocopies of certain documents
  4. Solemnize marriages
  5. Verify vehicle identification numbers (VINs)
  6. Certify the contents of safe deposit boxes

Though a notary certifies that a signature is made willingly and freely. A notarization does not prove a document or statement is true or accurate, nor does a notarization validate or legalize a document. Furthermore, separate laws and guidelines vary across every state. As well as policies on fees and jurisdiction. Notaries are publicly commissioned officials and they are expected to follow written rules without the exercise of significant personal discretion, as would otherwise be the case with a “judicial” official.
